Common Challenges Women Face in Family Law Cases

It is an unfortunate reality that women face many unique obstacles when dealing with divorce, custody disputes, and financial matters. After spending your best years caregiving for children or supporting your spouse, the system can feel stacked against you. Some common challenges when faced in court include:

  • Financial struggles: Many women come to family court with limited income or job experience due to their years dedicated to domestic duties and raising children. These realities can create financial stress and worries about how they will support themselves post-divorce.
  • Custody disputes: Mothers who spent years as the primary caregivers for their children are often still required to prove that they can provide a stable home for their children.
False allegations: Women and mothers often face false allegations from their former partners in an attempt to manipulate child custody cases in favor of fathers.
  • Domestic violence: Leaving an abusive marriage takes courage, and many women fear for their safety during a divorce. With legal representation, they can secure a protective order that safeguards them from danger.
  • Unequal financial footing: Some spouses hide their finances in an effort to control or manipulate the legal process or avoid paying child support. Many wives come to court with little access to joint bank accounts and limited access to financial records.

These are just some of the problems that women and mothers face in family court. Having strong legal representation from a San Antonio female family law attorney can help you protect your rights so you can move forward and rebuild your life with confidence.

Understanding the Rights of Stay-at-Home Moms

Alimony spelled on block letters.

Women who pause or sacrifice their career ambitions to raise their children often find themselves financially compromised during a divorce. They may lack the job experience to easily reenter the job market. Fortunately, Texas family courts recognize these hardships and allow for relief through:

  • Alimony: Also known as maintenance, the courts have the discretion to award temporary spousal support during a divorce proceeding or post-divorce maintenance based on the financial needs of the mother.
  • A fair share of the marital estate: Wives are entitled to a portion of the marital estate, which includes property, retirement accounts, and savings accumulated during the marriage. If you inherited or were gifted any assets during the marriage, you are free to keep them.
  • Child support: Primary custodians are often eligible for child support payments. The courts are interested in seeing that children from a marriage have the financial support they need. Even when the child was born outside of marriage, child support can still be levied on the biological father once paternity is established.

While these and other rights can help women in family court make up for some of the obstacles they face, there are no guaranteed outcomes in court. Often, securing a favorable outcome requires strong legal representation that can advocate for you.

Domestic Violence and Legal Protections for Women

Leaving an abusive marriage can place women in danger. They often flee with few material resources and worry about the safety of their children as well. Texas takes domestic violence seriously. The abuser can face criminal charges and consequences in family court.

With help from a San Antonio family law attorney, you can receive these and other critical protections:

  • Protective orders: Protective orders prevent abusive spouses from contacting you or approaching you. In Texas, they can also require the abuser to move out of a shared home, surrender firearms, and follow additional restrictions set by the court. Unlike restraining orders, which are broader and can apply to various legal disputes, protective orders specifically address threats.
  • Emergency custody orders: A judge can review evidence that a child could be in danger when ordering temporary orders that restrict visitation from one parent.
  • Supervised visitation: If you have concerns that the other parent poses a danger to your children, you can also ask the courts to order supervised visitation.

If you are the victim of domestic abuse, you can discuss your situation with your San Antonio family lawyer. Anything you discuss with your attorney is 100% confidential.

How Property Division Works in Texas Divorce Cases

Texas follows community property laws, meaning that most assets acquired during the marriage are considered joint property and are subject to equal division. However, an equal split is not always guaranteed. The courts aim for a just and fair division of assets and debts based on each spouse’s financial situation. Factors that influence property division include: wasteful spending or hiding of marital assets.

If you brought assets into a marriage or inherited assets during your marriage, those forms of separate property should not be subject to division.

Understanding Child and Spousal Support in Texas

Child and spousal support help provide financial stability for women after divorce.

Child support is determined by calculating a percentage of  the obligors monthly net resources. The percentage is determined by how many children are subject of the lawsuit and how many other children outside the lawsuit the obligor has.

Spousal maintenance is awarded only in limited cases, such as when a marriage lasts at least 10 years, and the recipient lacks the ability to provide for their minimum reasonable monthly needs.. Spousal maintenance may also be granted when the recipient has a disability preventing self-support, or they care for a dependent with a disability.

San Antonio Family Law Attorney FAQs

A San Antonio family law attorney can guide you through divorce proceedings, ensuring your assets are protected, advocating for fair financial support, and helping you secure a custody arrangement that prioritizes your child’s well-being. They also handle legal filings, negotiations, and court representation to protect your interests.

Texas courts generally favor joint custody, but sole custody may be granted if the other parent is abusive, neglectful, or otherwise unfit. A family lawyer can help gather documentation, such as police reports, medical records, and witness statements, to demonstrate why full custody is necessary.

In Texas, child support is calculated based on a percentage of the non-custodial parent’s income, with adjustments for medical expenses, childcare costs, and other necessary expenses. An attorney can help ensure the calculations are accurate and that all relevant financial factors are considered.

Failure to pay child support can result in legal consequences such as wage garnishment, property liens, and suspension of professional or driver’s licenses. If your ex-spouse refuses to pay, a family lawyer can assist with filing an enforcement motion to compel payment or seek penalties for noncompliance.

Victims of domestic violence in Texas can request protective orders that legally prevent an abuser from contacting them. Courts may also grant emergency custody modifications to protect children from harm. An attorney can help file for these protections, represent you in hearings, and work with law enforcement to ensure compliance.
